Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Omnibo, Inc. (“Omnibo,” “we,” “us,” or “our”) governing your access to and use of the Omnibo platform and services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

Description of Services

Omnibo provides a unified platform for accessing multiple AI models, including but not limited to GPT-5, Claude, Gemini, and other large language models. Our services include:

• Access to 50+ AI models through a single interface
• API access for integration with your applications
• Model comparison and evaluation tools
• Team collaboration features
• Usage analytics and monitoring

Account Registration

To access certain features of our services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the services to generate illegal, harmful, or abusive content
• Attempt to bypass usage limits or access controls
• Reverse engineer, decompile, or disassemble our services
• Use automated systems to access the services without permission
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the integrity of our services
• Impersonate any person or entity
• Collect or harvest user information without consent
• Use the services to compete directly with Omnibo
• Violate any applicable laws or regulations

AI Model Usage

Third-Party Models

Our platform provides access to AI models operated by third parties (OpenAI, Anthropic, Google, etc.). Your use of these models is also subject to the respective providers' terms of service and acceptable use policies.

Content Responsibility

You are solely responsible for:

• The prompts and inputs you provide to AI models
• How you use and distribute AI-generated outputs
• Ensuring your use complies with applicable laws
• Verifying the accuracy of AI-generated content

No Guarantee of Accuracy

AI models may produce inaccurate, incomplete, or biased outputs. We make no warranties regarding the accuracy, reliability, or suitability of AI-generated content for any particular purpose.

Subscription and Payment

Pricing

Our services are offered through various subscription plans. Prices are subject to change with reasonable notice. Current pricing is available at omnibo.ai/pricing.

Billing

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

Refunds

All subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

Usage Limits

Each subscription plan includes specific usage limits. Exceeding these limits may result in additional charges or service restrictions.

Intellectual Property

Our Property

The Omnibo platform, including its design, features, and content, is owned by Omnibo and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.

Your Content

You retain ownership of content you create using our services. By using our services, you grant us a limited license to process your content as necessary to provide the services.

AI-Generated Content

Ownership of AI-generated content is subject to the terms of the respective AI model providers. We recommend reviewing their policies regarding output ownership.

Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Disclaimers

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim warranties of:

• Merchantability and fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service
• Security of data transmission

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNIBO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

Our total liability for any claims arising from these Terms or your use of the services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Omnibo, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share using the services

Termination

We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the services ceases immediately
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco, California.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date.

Your continued use of the services after changes become effective constitutes your acceptance of the revised Terms.
